THE CONSTITUTIONAL COURT REMOVES ‘OFFENSIVE ACT' FROM THE CRIMINAL CODE

In 16 January 2014, the Constitutional Court (“MK”) granted the request for a judicial review of Article 335 of the Criminal Code (“KUHP”) and removed the phrase, “offensive act” from Article 335 of the KUHP. The reason for removing the phrase, “offensive act” is that it allows investigators and public prosecutors to act arbitrarily against certain people. In its considerations, the MK said that the phrase, “offensive act” in Article 335 paragraph (1) of the KUHP has caused legal uncertainty and injustice.

INTERNET CONTENT CENSORSHIP STRENGTHENED

Internet Content Censorship Strengthened The Minister of Communications and Informatics issued Regulation No. 19 of 2014 on Controlling Internet Websites Containing Negative Content (Regulation 19). Regulation 19 has been in force since 17 July 2014. This regulation aims to implement “the safe and healthy use of the internet” by all social groups by blocking access to websites that contain pornographic or unlawful material (negative content).

MANDATORY BKPM ONLINE COMPANY FOLDERS

On 25 August 2014, BKPM issued Circular Letter No. 252/A.8/2014 on Company Folders. This new system is known as the Electronic Investment Service and Investment Licensing System (Sistem Pelayanan Informasi dan Perizinan Investasi Secara Elektronik or SPIPISE). BKPM aimed to introduce the SPIPISE system on 1 October 2014.

NEW COPYRIGHT BILL ANNOUNCED

On 16 September 2014, the House of Representatives finally passed the Bill on Copyright (Copyright Bill). The Copyright Bill repeals and replaces the current copyright law, Law No. 19 of 2002 on Copyright. The Copyright Bill regulates various new topics which were not discussed in the current Copyright Law, among others as below.

NEW INSURANCE BILL PASSED

The Insurance Bill (Insurance Bill) was passed by the House of Representatives on 23 September 2014. The Insurance Bill repeals and replaces the current Law No. 2 of 1992 on The Insurance Business.
