NEW REGULATION ON INDUSTRIAL BUSINESS LICENSES

In December 2015, the Government of Indonesia issued Government Regulation No. 107 of 2015 on Industrial Business Licenses (“IUI”) (“PP 107/2015”). PP 107/2015 came into effect on 28 December 2015 and revoked the previous Government Regulation No. 13 of 1995.

THE DRAFT E-COMMERCES REGULATION TO BE ISSUED IN 2016

The highly anticipated draft e-commerce regulation has been expected to be issued since mid-2015 according to the Minister of Trade (“MOT”), and since then becomes the object of major discussion and debate from stakeholders.

THE DRAFT DATA PROTECTION LAW IS UNDER DISCUSSION AND EXPECTED TO BE ISSUED SOON

The protection of personal data is an interesting area of IT law, since it is generally covered in Law No. 11 of 2008 on Electronic Transactions & Information (“Law 11/2008”), and briefly mentioned in the draft e-commerce regulation. Under Law 11/2008, electronic system providers must retain transaction data and personal information that includes consumers’ data for at least 10 years.

NEW PENSION AND OLD AGE SECURITY REQUIREMENTS

The Government of Indonesia has recently issued a series of regulations in an attempt to further regulate pension securities and amend the old age security programs in Indonesia, namely Government Regulation No. 45 of 2015 on the Management of the Pension Security Program (“GR 45/2015”) and Government Regulation No. 46 of 2015 as amended by Government Regulation No. 60 of 2015 on the Management of the Old Age Security Program (“GR 46/2015”).

UPDATE ON THE OBLIGATION TO USE RUPIAH AND EXEMPTIONS

As an update to our previous Newsletter regarding Regulation No. 17/3/PBI/2015 regarding the Obligation to Use Rupiah in the Territory of the Republic of Indonesia (“BI Regulation”), Bank Indonesia (“BI”) has issued an implementing regulation regarding the mandatory use of Rupiah under BI Circular Letter No. 17/11/DKSP (“Circular 17”).
