THE SELLER MUST PROVIDE INFORMATION ON THE RETAIL PRICE AND TARIFF OF GOODS AND/OR SERVICES

Under Regulation of the Minister of Trade No. 35/M-DAG/PER/7/2013 dated 29 July 2013 on Affixing Retail Prices and Tariffs to Goods and Services (“MOT Regulation No. 35/2013”), the Government requires retailers to affix clear, readable and foreseeable retail prices to their goods and/or services. The information on the price or tariff of the goods must state whether the purchase price includes tax and other fees. In the case of services, the information on service fees or tariffs must also provide the formula used to determine the fees or tariffs (based on time, distance, or capacity, etc.). MOT Regulation No. 35/2013 also covers online shops which must provide price information that is easily accessible to consumers. However, this obligation does not apply to so-called micro businesses, unless required by the relevant authority.

Upon failure to comply with this requirement, sellers are liable to revocation of their business license. The regulation will come into effect 6 months as of its issuance, ie on 29 January 2014.
